Terms and Conditions

BETWEEN: RainCity Decks & Waterproofing Ltd., hereinafter referred to as “RCD”

AND: [Home Owner] (“OWNER”)

CONTRACT DOCUMENTS

The contractual agreement between RCD and the OWNER includes this contract document and any additional documentation, including but not limited to, photographs, emails, and other communication related to “Extras” or changes initiated during the performance of this contract.

TERMS OF PAYMENT

The contract price is based on a fixed-cost estimate unless a Time & Materials (T&M) arrangement is specified in the Scope of Work. Payment shall be made as follows:

  • 50% of the total contract amount is due upon the approval of the quote.
  • The remaining 50% is due upon the completion of the contract.

Accepted payment methods include e-transfers and cheques. E-transfers should be sent to [email protected], and cheques must be made payable to RainCity Decks & Waterproofing Ltd.. The project will be scheduled once the deposit is received.

EXTRAS OUTSIDE OF THE INITIAL SCOPE OF WORK

In the course of executing the contract, RCD may encounter unforeseen circumstances requiring additional work (“Extras”) or amendments to the Scope of Work to complete the project. One common instance of such “Extras” is the discovery of lumber rot, which necessitates additional demolition, materials, and labor to repair.

In such cases:

  1. RCD will notify the OWNER promptly of the discovery of any “Extras.”
  2. RCD will provide a written email detailing the change to the Scope of Work and the next steps required.
  3. RCD will furnish the OWNER with daily updates regarding the progress of work related to the “Extras.”

The cost of “Extras” will be charged at an hourly rate of $95 per man-hour, and any additional materials required will be billed at Cost + 20%.

STANDARDS OF WORK

RCD agrees to provide all labor, materials, and supervision necessary to complete the work as outlined in the contract documents. RCD will perform all work diligently, in a good and workmanlike manner, adhering to high-quality residential standards, and in compliance with applicable Building Codes and other relevant authorities.

The OWNER is responsible for ensuring that the work area is reasonably free from household obstructions and for removing or protecting personal items in areas that may reasonably be exposed to dust, damage, or vibrations during the execution of the work.

WARRANTY

RCD warrants that all work performed under this contract will be free from defects in workmanship for 5 years from the date of full completion. The OWNER must provide RCD with written notice of any defects within a reasonable time after discovery and, in any event, within the warranty period.

In addition, RCD will pass on to the OWNER any manufacturer or supplier warranties for individual materials, products, or systems used in the project, such as the Duradek warranty. RCD does not warrant any labor or materials provided by the OWNER or by subcontractors engaged by the OWNER.

INSURANCE

Before commencing any work, RCD agrees to maintain and provide insurance coverage, including commercial general liability insurance, with a minimum coverage of $5 million against claims for personal injury or property damage resulting from the work performed under this contract.

Upon request, RCD will provide the OWNER with proof of valid insurance coverage and a WorkSafe BC clearance letter confirming that RCD complies with its obligations under WorkSafe BC regulations.
